1. Acceptance of terms

These Terms of Service (“Terms”) govern your use of the Lynkame platform, a brand operated by Gustavo Gabry Orcay (Brazilian sole-proprietor / MEI), registered under CNPJ 66.826.643/0001-05 (“we”, “us”, or “the platform”). By creating an account, activating an NFC card, or using any part of the service, you (“user”) fully agree to these Terms and to our Privacy Policy.

If you disagree with anything, do not use the service. You can close your account at any time (clause 12).

2. About the service

Lynkame offers:

  • Physical NFC cards linked to a public profile reachable via URL and NFC tap;
  • Tools to customize that profile (links, social handles, photo, bio, scheduling, menu, forms, videos, products);
  • Optional integrations for Pix payments (Mercado Pago) and subscription billing (Stripe);
  • AI WhatsApp bot (paid plans) and a B2B team dashboard (Business plan).

3. Your account

3.1 Creating an account

Creating an account requires a valid activation code (printed on the NFC card or sent by your team's manager). You are responsible for the accuracy of the information you provide.

3.2 Security

You are responsible for keeping your password confidential and for any activity carried out with your credentials. Notify us at support@lynkame.com.br immediately if your account is accessed without authorization.

3.3 Minimum age

You must be at least 13 years old to use the service. Users between 13 and 17 may only use it with parental or legal guardian consent (LGPD art. 14).

4. NFC card

The physical NFC card belongs to you after purchase or activation. Each card has an immutable UUID that points to your profile at /p/{uuid}. You can change profile content at any time; the UUID itself is permanent and cannot be changed.

4.1 Defects and replacement

Cards with manufacturing defects will be replaced at no cost within the legal warranty period (Brazilian Consumer Defense Code, art. 26). Loss, damage from use, or misplacement can be remedied by purchasing a new card.

5. User content

You retain all rights to content you publish (text, photos, videos, links, products). By publishing it you grant Lynkame a non-exclusive, royalty-free, worldwide license, valid for the duration of your service usage, to host, display, resize, optimize (compression, thumbnails) and distribute that content solely to operate the platform.

You represent and warrant that you hold all necessary rights over the content you publish (including the right to use images of people, brands, and music).

6. Acceptable use

You agree not to use the service to:

  • Publish illegal, fraudulent, misleading content, or content that infringes third-party rights;
  • Promote hate, violence, discrimination, or exploitation of minors;
  • Publish pornographic or sexually explicit content;
  • Send spam, run pyramid schemes, phish, or distribute malware;
  • Impersonate another person, company, or brand;
  • Attempt to bypass technical limits, reverse engineer the platform, or deliberately overload the service;
  • Use end-customer data (leads, orders) for purposes other than the one that originated the submission.

Violating these rules may result in content removal, account suspension, or termination without prior notice.

7. Paid plans and billing

7.1 Plans

The service offers a free plan and paid plans (Pro, Business), with features described on the subscription page. Current pricing is on /billing.

7.2 Billing

Subscriptions are processed by Stripe. Monthly and yearly charges auto-renew until you cancel.

7.3 Cancellation

You can cancel any time from the subscription portal. Access to paid features continues until the end of the already-paid cycle.

7.4 Right of withdrawal

Under art. 49 of the Brazilian Consumer Defense Code, you have 7 days from the subscription date to withdraw with a full refund. Requests via support@lynkame.com.br.

7.5 NFC card bundle

Orders that include the physical card may be withdrawn only before the shipping label is issued; after shipping, the defect-replacement window in clause 4.1 applies.

8. Payments from your end customers

When you enable Pix on your profile, payments from your customers go directly to your linked Mercado Pago account. Lynkame does not hold, custody, or process those funds — we provide only the technical infrastructure.

Lynkame may charge a platform fee on transactions processed through paid service features, as indicated at /billing. You alone are responsible for issuing tax receipts, complying with tax obligations, and standing behind the quality of the goods/services offered to your end customers.

9. Service availability

We aim to keep the service available at all times, but we do not guarantee uninterrupted uptime. There may be maintenance windows, third-party outages (hosting provider, Stripe, Mercado Pago, Meta), or events beyond our control. The free plan is provided “as is”, with no additional warranty.

10. Intellectual property

The Lynkame brand, website, source code, design, product name, and logos belong to us or our licensors. Nothing in these Terms transfers intellectual property to you beyond the right to use the service while your account is active.

11. Limitation of liability

To the maximum extent permitted by law, Lynkame is not liable for indirect damages, lost profits, or data loss arising from your use of, or inability to use, the service. Our total liability, under any circumstance, is limited to the amount you actually paid in the 12 months preceding the event giving rise to the claim.

This limitation does not apply to cases of willful misconduct, fraud, or violations of consumer rights protected by mandatory law.

12. Termination and suspension

You may close your account at any time by writing to support@lynkame.com.br. We may suspend or terminate your account if we identify a breach of these Terms, abusive use, a valid court order, or non-payment of subscription fees.

Data retention periods after closure are described in the Privacy Policy.

13. Changes to these terms

We may update these Terms to reflect changes to the service, the market, or applicable law. Material changes will be communicated by email and/or via a dashboard notice at least 15 days in advance. Continued use of the service after that period means you accept the new version.

14. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The consumer's domicile is the elected venue to resolve any disputes arising from these Terms, except for other venues mandated by law.
